Can single seat experimental aircraft be rented out to qualified pilots?


I have seen a lot of yes's and no's to this question on the internet but nothing definitive. The closest thing I've found was something called "EAA exemption 7162". This seemed to have more to due with actual training in ultralights and experimentals. But it also looks like it was not continued.

My question is if it is possible to have a small fleet of experimental aircraft available for rent to qualified pilots? "Qualified pilots" being a person holding a least a private pilots license (and also being current) in close relation to the experimental aircraft in question. I.E. fixed wing/rotary wing/ gyro/blimp/whatever....

I realize that there are insurance and liability issues and cost and all that, so please do not comment on that. All I want to know is if this is legal or not and to be pointed in the direction of the actual print that tells me "yay" or "nay"

exemption 7162 has been retired (2007 I believe) and no longer valid. If you want to charge for the use of your experimental for flight training,you will need to contact the Operations Supervisor at yotr local FSDO and apply for an Experimental Aircraft Flight Training Letter of Deviation as outlined in FAA Notice N 8900.15
As far as renting your aircraft to certificated pilot, as long as no instruction is conducted, yes you can

You will notice that renting your experimental as you describe is not forbidden

Added: Sorry Zaphod, I have to disagree with you on this one. If you provide the pilot and the aircraft, or charge passengers more than their pro rata share,then it is considered a Commercial operation. Merely charging for the use of your aircraft is not commercial as far as the FAA is concerned. Your Insurance company might disagree, but that is another whole ball of wax.
